"Berry Good Times is actually a registered trademark exclusively owned by Dayung's — be careful of infringement!
What trademark strategies have chain beverage store headquarters been quietly implementing?

You often see a TM or symbol at the top right corner of a brand's logo.
In fact, this indicates that the brand headquarters has trademark protection awareness.
They do not want other companies to use their brand name or logo,
and therefore, they file trademark applications with trademark offices in various countries!"

Some of the more well-known trademark applications filed by beverage chain headquarters in Taiwan include:

1. Dayung's Beverage Store
Applied for trademarks such as:
"Berry Good Times," "Grapefruit Beauty Bits," "Cranberry Beauty Bits," "Blossoming This Summer," "Mango Waltz," "Berry Valentine," "Peach You Like," and others.

As a result, many competitors selling grapefruit juice, strawberry milk, and mango ice must be particularly cautious with product naming to avoid trademark infringement!

2. Magu Beverage Store
Applied for trademarks like "Magu Cheese Foam," "Magu Bubbles," and "Magu Delight."
Interestingly, over a decade ago (112 years by the Taiwanese calendar), the trademark applications were filed under an individual's name — Jian Xiujian.

This clearly shows that Magu’s headquarters is very protective of the “Magu” brand name, aiming to prevent others from launching drinks associated with Magu.

3. 50 Lan (Wu Shi Lan) — a leading beverage chain
Filed trademarks for "Cocoa Ballet" and "Pineapple Red Tea" in 2008 and 2015 (Taiwanese calendar years 97 and 104).

From 50 Lan's strategy, it’s evident that these two products were heavily promoted in the early days.
If another beverage store were to use pineapple plus black tea and name it something like "Pineapple Red Tea," it would definitely be considered a direct competition and trademark violation.

4. For trademarks specifically protecting "Pearl" or "Brown Sugar Pearl" products:

  • Xiao Zuo Tea Works, a well-known Taichung beverage chain, applied for exclusive trademark rights for "Sunset Pearl."
  • Xiao Cha Zhai applied for "Lava" as a trademark specifically for tapioca pearls.

If your product features are difficult to protect through patents,
you should consider coming up with a distinctive or arbitrary name
that is easy for consumers to remember,
and file for trademark protection with the Intellectual Property Office as soon as possible.

Otherwise, you might end up like Ching Shin’s "Jade Lemon" (翡翠檸檬), which eventually became a product that anyone could sell!
