Suddenly thought of this: “Would using Foodpanda’s pink color for marketing promotion involve trademark infringement?”
Foodpanda previously challenged with a color trademark, attempting to exclusively use “pink” across multiple categories including mobile applications, advertising services, electronic payments, delivery, and food services.
Once the color trademark is approved, it would mean that other businesses in the same industries would not be allowed to use similar colors within the designated scope.
Unfortunately, at that time Foodpanda received an office action and did not submit any argument or correction to fight for approval, and the rejection decision was received in 2022 (Year 111 of the ROC calendar).
It is now confirmed that other businesses can safely use that color in their advertisements.
From TIPO records, it is also seen that other approved trademarks under Foodpanda have already been officially transferred to the German company Delivery Hero SE as of this January.
