Recently, Taiwan’s Ministry of Finance – Customs Administration announced a regulatory amendment:
Starting June 2025, counterfeit goods that infringe trademark rights and are smuggled into the country will no longer qualify for minor penalty exemptions.

If goods are found to be inauthentic and infringe patent rights, trademark rights, or copyrights, violators may face fines of up to three times the value of the goods.

This means that regardless of the monetary value of the counterfeit product, if it involves trademark infringement, the offender will be held legally liable and fined.

This policy shift clearly demonstrates the government’s strengthened commitment to intellectual property (IP) protection, and serves as a serious reminder to businesses and individuals alike:
Trademark protection and lawful use can no longer be overlooked.

If you're unsure about the status of your brand’s trademark, now is the time to act.

What Are the Impacts of This New Regulation?

1. For Consumers

When purchasing goods, it's critical to verify the source and authenticity of the trademark to avoid buying counterfeit items.
Beyond monetary loss, bringing counterfeit goods across borders may now constitute a legal violation.

Many people are used to shopping via cross-border e-commerce or through personal purchasing agents for small-value goods. In the past, if counterfeit products were purchased unintentionally, they may have been exempt from punishment due to low value.

However, under the new rules, even small-value counterfeit goods will be subject to stricter enforcement and heavier penalties.

👉 Gold Keen reminds you: Always ensure the legality of product sources. Don't risk violating the law for the sake of a bargain.

2. For Brand Owners

This amendment is a major advantage for businesses and trademark holders.

Take a close look at your brand logo—
If you haven’t registered your trademark yet, you’re leaving yourself open to counterfeiters, who may damage your brand’s reputation and market value.
